This is an original action instituted by Relator Brumfield in May, 1981. Relator filed motions below for discharge pursuant to Ind. R. Crim. P. 4(C) and (F), and such motions were denied in the trial court. Following a preliminary proceeding in this Court we refused to grant a temporary writ.
